Terms and Conditions

§ 1 Scope, Definitions

a. https://www.horando.de is a service provided by Horando Deutschland GmbH, represented by its managing directors, Mr. Christopher Fischer and Mr. Stefan Sebök, Georgstrasse 38, 30159 Hannover, Germany (hereinafter “Horando”).

b. These Terms and Conditions apply to the purchase and sale of the goods offered on https://www.horando.de (hereinafter the “Website”).

c. “Consumers” are defined as persons within the meaning of Section 13 of the German Civil Code (BGB), i.e., natural persons who enter into the respective legal transaction for a purpose that cannot be attributed to their commercial or self-employed professional activities. In all other cases, customers are considered “businesses” pursuant to Section 14 of the German Civil Code (BGB).

§ 2 Contracting Party

Your contracting party for all orders is Horando Deutschland GmbH, represented by managing directors Christopher Fischer and Stefan Sebök, Georgstrasse 38, 30159 Hannover (hereinafter “Horando”)

§ 3 Order / Brokerage / Conclusion of Contract

I. Ordering in the Web Store

To place an order with Horando, follow these steps:

1. Add items to the shopping cart
2. Enter your billing and shipping address
3. Review your entries (billing and shipping addresses, product, price, quantity)
4. Enter payment information 
5. Complete the order by clicking “Place Order with Payment.” 

The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the “Place Order” button, you are submitting a binding order for the items in your shopping cart. Confirmation of receipt of your order will be sent immediately after you submit it; this does not yet constitute acceptance of the contract.

After submitting your order, you will receive an email confirming that we have received your order and listing its details (order acknowledgment). This does not yet constitute the formation of a purchase contract; it merely confirms that we have received your order.
No later than the delivery of the goods, you will receive all customer information from us, which you should print out for your records.

The sales contract is not concluded until the goods are shipped or a separate email “Order Confirmation” is sent. Contracts on our website are concluded exclusively in German.

II. Brokerage

If you inquire with Horando about precious metals, watches, or other items that are not currently available in the shop, the process is as follows:

1. Fill out the contact form and request the desired product
2. You will then receive a confirmation of receipt
3. After reviewing your request, we will send you an offer
4. You may accept or decline the offer. 

If you accept the offer, you will receive an “Order Confirmation.” Please note that the binding purchase contract is not concluded until you receive this separate email “Order Confirmation.” Contracts on our website are concluded only in German.

§ 4 Storage of the Contract Text

Your order will be stored at https://www.horando.de. Please print out the order confirmation after completing the ordering process for your records. You will receive the order details in the order confirmation via email; however, for security reasons, they can no longer be accessed on our website.

§ 5 Delivery

Orders and deliveries are only possible to shipping addresses within the European Union (EU). If you would like a delivery to another country, we are happy to assist you personally in resolving your request: service@horando.de.
Please note that additional customs duties, taxes, and fees apply to deliveries to non-EU countries.

Start and Calculation of the Delivery Period:
The delivery period begins after order confirmation; for prepayment, it begins at the time the buyer issues the payment instruction. The time frame specified refers to business days.

§ 6 Pricing Information and Limited-Time Offers

a.) All prices listed are retail prices and include VAT and shipping within the European Union. The price valid at the time of order applies. The contract and billing currency is exclusively the euro.

b.) Please note that offers at Horando may be limited in time due to strict restrictions imposed by the manufacturer. This will be specifically noted in the respective product description.

c.) If the ordered item is unavailable because our suppliers fail to deliver it to us—through no fault of our own and despite their contractual obligation—we are entitled to rescind the contract. In this case, we will immediately inform you that the ordered goods are no longer available and, if applicable, promptly refund any payments already made. If, in exceptional cases, the ordered item cannot be delivered within the specified delivery time because our suppliers are unable to deliver the product on time, you may withdraw from the contract. In this case as well, we will promptly refund any payments already made.

d.) Customers outside the EU should note that customs duties may be payable upon shipment, which will be added to the final price of your order.

§ 7 Payment

1. Payment may be made by prepayment/bank transfer, credit card (Visa, Mastercard, American Express), PayPal, Klarna (e.g., invoice or installment plan), or Sofortüberweisung.
2. If you select the “prepayment” payment method, we will provide you with our bank account information in the order confirmation. The invoice amount must be transferred to our account within 10 days.
3. If you pay by credit card, your account will be charged upon completion of your order.
4. If you select PayPal or Klarna as your payment method, the payment will be processed by the respective payment service provider in accordance with its terms of use. If necessary, you will be redirected to the website of the respective payment provider during the ordering process.
5. Horando reserves the right to exclude certain payment methods or offer them only on a limited basis in individual cases, particularly depending on the order value, the delivery country, or a credit check.
6. For payments in a foreign currency, the exchange rate is set by the payment provider you have selected. Any refunds will be issued in the amount of the original euro amount received. Horando assumes no liability for currency conversion fees charged by third parties or fluctuating exchange rates.

§ 8 Liability

1. Notwithstanding other statutory requirements for claims, the following exclusions and limitations of liability apply to Horando’s liability for damages.
2. Horando bears unlimited liability to the extent that the cause of the damage is based on willful misconduct or gross negligence.
3. Furthermore, Horando is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper performance of the contract and on whose compliance you regularly rely. In this case, however, Horando is liable only for foreseeable damages typical for this type of contract. Horando is not liable for the breach of obligations other than those mentioned in the preceding sentences due to slight negligence. 
4. The above limitations of liability do not apply in cases of injury to life, body, or health; for defects arising after Horando has assumed a warranty for the quality of the product; or in cases of defects fraudulently concealed. Liability under the Product Liability Act remains unaffected. 
5. To the extent that Horando’s liability is excluded or limited, this also applies to the personal liability of employees, representatives, and agents.

§ 9 Warranty and Guarantees

1. Statutory warranty rights apply. For new goods, the statutory limitation period for claims for defects is two years from the date of delivery of the goods. For used goods, the limitation period for claims for defects is one year from the date of delivery of the goods.
2. If special warranties apply to products, your statutory claims for defects remain unaffected. The contact person for the respective warranty is listed in the applicable warranty terms and conditions, which are included with the ordered product. If you do not have these terms and conditions on hand or if the item is not a technical product, please contact our customer service.
3. If delivered items exhibit obvious material or manufacturing defects or damage incurred during shipping, we ask that you report such defects to us or to the carrier delivering the items as soon as possible. The customer is under no obligation to do so, and this is not a prerequisite for asserting your statutory claims. However, complying with this policy facilitates the enforcement of any potential claims against the carrier. Your statutory rights remain unaffected by this.

§ 10 Right of Withdrawal

1. Consumers as defined in § 13 of the German Civil Code (BGB) generally have a statutory right of withdrawal for distance sales contracts. Details regarding the right of withdrawal and the consequences of withdrawal are set forth in our separate withdrawal policy.
2. In the event of a withdrawal, the customer must return the goods in their entirety and in their original packaging. The goods, including all components supplied with them (e.g., original box, warranty cards, documents, accessories, protective films, and any removed watch links), must be in their original condition.
3. The purchase price will be refunded within 14 days of Horando’s receipt and inspection of the returned goods.
4. The refund will be issued via the same payment method you used for the original transaction, unless otherwise expressly agreed.
5. The customer must compensate for any loss in value of the goods if such loss is attributable to handling of the goods that was not necessary for inspecting their nature, characteristics, and functionality.

§ 11 Retention of Title

The delivered goods remain the property of Horando until full payment has been made.

§ 12 Governing Law; Jurisdiction; Contract Language

1. The law of the Federal Republic of Germany applies to all legal transactions or other legal relationships with us—and, in the case of orders for Horando partner items, also with the Horando partners. The United Nations Convention on Contracts for the International Sale of Goods (CISG) and any other international agreements, even if incorporated into German law, do not apply. In the case of contracts entered into for a purpose that cannot be attributed to the beneficiary’s professional or commercial activities (consumer contracts), this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has his or her habitual residence. 
2. In business dealings with merchants and legal entities under public law, the place of jurisdiction for all legal disputes arising from these Terms and Conditions and from individual contracts concluded under their terms, including actions relating to bills of exchange and checks, is agreed to be the registered office of Horando (Bamberg). In this case, we are also entitled to bring an action at the customer’s place of business. 
3. The language of the contract is German.

§ 13 Partner Network and Immediate Availability

Horando works with a partner network consisting of various jewelers and authorized dealers. “Immediate availability” does not imply that these watches are physically in stock at the showroom in Bamberg.
